A thing which sets a criminal and a civil case apart is the outcome of each litigation. A civil case, being a litigation only between private parties, only affects the private lives of the individuals involved. A criminal case on the other hand is a case which has, perhaps, more severe penalties like incarceration and indemnification. It not only affects the private lives of the individuals involved in a litigation but also affects the affairs of the state. It is the state's duty to protect its interest, one of which is to promote the security of its citizens.

Defense trial is only limited to criminal case. A defense attorney is needed to represent and defend a part accused of a felony or a misdemeanor. Defense Trial Attorneys are only found in criminal cases. Because only criminal conduct are prosecuted with need of a defense, because the charge incurs a felony and not just a civil penalty, or a change in civil status as in divorce, or monetary settlements.

The focus of defense trial attorneys are on the heavier proof of innocence of their client. Because an accused is presumed innocent until proven guilty. The Bill of Rights entitle the accused the presumption of innocence until his guilt on the crime is proven beyond reasonable doubt.

Criminal Defense require passion from the attorney. Not only is it a very daunting task of proving the innocence, and disproving the guilt, of an accused.
